Q: An international colloquium was held in Beijing on July 29 themed “International Law in the Changing World: The Role of Developing Countries”. Can you tell us more about it? What signals does it send to the world?
答:“大變局下的國(guó)際法:發(fā)展中國(guó)家的作用”國(guó)際研討會(huì)是由外交部和中國(guó)國(guó)際法學(xué)會(huì)共同舉辦的。國(guó)務(wù)委員兼外交部長(zhǎng)王毅向研討會(huì)致賀信。外交部副部長(zhǎng)羅照輝出席會(huì)議開幕式并講話。國(guó)際法院院長(zhǎng)優(yōu)素福出席研討會(huì)并發(fā)表主旨演講。共有來(lái)自80多個(gè)國(guó)家的法律官員和駐華使館代表,聯(lián)合國(guó)、國(guó)際海洋法法庭、國(guó)際紅十字會(huì)、亞洲—非洲法律協(xié)商組織等國(guó)際組織代表和國(guó)內(nèi)外專家300多人參加了這次研討會(huì)。
A: The international colloquium themed “International Law in the Changing World: The Role of Developing Countries” was co-hosted by the Chinese foreign ministry and the Chinese Society of International Law. State Councilor and Foreign Minister Wang Yi sent a congratulatory letter to the colloquium. Vice Foreign Minister Luo Zhaohui attended and addressed the opening ceremony. President Abdulqawi Ahmed Yusuf of the International Court of Justice attended the colloquium and delivered a keynote speech. More than 300 delegates attended the colloquium. They include law officials and representatives of foreign embassies in China from over 80 countries, representatives of the United Nations, the International Tribunal for the Law of the Sea, the International Committee of the Red Cross, the Asian-African Legal Consultative Organization and other international organizations, and Chinese and foreign experts.
這次研討會(huì)重點(diǎn)圍繞“大變局下的國(guó)際法向何處去”、“發(fā)展中國(guó)家對(duì)維護(hù)國(guó)際法的作用”展開討論。在當(dāng)今世界面臨百年未有之大變局,個(gè)別國(guó)家的單邊主義、保護(hù)主義和霸凌行徑嚴(yán)重沖擊國(guó)際法和國(guó)際秩序的情況下,這次研討會(huì)具有很強(qiáng)的現(xiàn)實(shí)意義。在這次研討會(huì)上,各方暢所欲言,進(jìn)行了熱烈的討論,達(dá)成了一些重要共識(shí):
Discussions in the colloquium focused on “international law in the changing world” and “the role of developing countries in upholding international law”. The world today is marked by changes unseen in a century. Certain country’s unilateralism, protectionism and bullying practices have seriously affected international law and order. Against such a backdrop, we believe this colloquium is particularly relevant. After open and warm discussions, all sides reached the following consensus.
第一,定規(guī)則、守規(guī)則是各國(guó)正確的相處之道,搞霸凌、行強(qiáng)權(quán)注定沒(méi)有出路。二戰(zhàn)結(jié)束以來(lái),以聯(lián)合國(guó)為核心、以國(guó)際法為基礎(chǔ)的國(guó)際體系為世界總體和平、穩(wěn)定與發(fā)展提供了制度保障,同時(shí)也為發(fā)展中國(guó)家贏得主權(quán)獨(dú)立和群體性崛起提供了有利環(huán)境。當(dāng)今世界單邊主義、保護(hù)主義和霸凌行徑抬頭,多邊主義和全球化遭遇逆流,國(guó)際法的權(quán)威和國(guó)際秩序受到?jīng)_擊。國(guó)際社會(huì)都在關(guān)注一個(gè)重大的問(wèn)題,那就是世界將向何處去。大家都認(rèn)為,我們比以往任何時(shí)候都更需要凝聚共識(shí)、共同努力,推動(dòng)加強(qiáng)國(guó)際法,尊重國(guó)際法,在國(guó)際事務(wù)中按國(guó)際法辦事,要摒棄“強(qiáng)者為所欲為、弱者逆來(lái)順受”的舊思維。因?yàn)檫@是世界從歷史中得來(lái)的重要經(jīng)驗(yàn),符合各國(guó)人民的意愿,也是人類進(jìn)步的必由之路。
First, the right way to develop state-to-state relations is setting and observing rules. Bullying practices and power politics will lead us nowhere. Since the end of World War II, the UN-centered international system based on international law has been a institutional guarantee to the overall peace, stability and development of the world. It has also provided a favorable environment for the sovereign independence and collective rise of developing countries. With unilateralism, protectionism and bullying practices on the rise, multilateralism and globalization are faced with headwinds, and the authority of international law and international order are undermined. The international community is focusing on one major question: where is the world heading? We all believe that we need to consolidate consensus and work together more than ever. We need to strengthen international law, respect it and follow it in dealing with international affairs. We must reject the outdated mindset of “the strong get all they want while the weak grin and bear it”. Those are important experiences the world has learned from history. They meet the aspiration of people of all countries and are necessary conditions for human progress.
第二,發(fā)展中國(guó)家作為國(guó)際舞臺(tái)上的重要力量,為國(guó)際法發(fā)展作出了歷史性貢獻(xiàn),現(xiàn)在有更大力量、更大責(zé)任共同堅(jiān)持正義、維護(hù)規(guī)則。在這次研討會(huì)上,各方都同意在國(guó)際規(guī)則制定中堅(jiān)持多邊主義,提升發(fā)展中國(guó)家的代表性和發(fā)言權(quán),都同意推動(dòng)國(guó)際法得到切實(shí)遵守,維護(hù)《聯(lián)合國(guó)憲章》確立的基本原則,維護(hù)以世貿(mào)組織為核心、以規(guī)則為基礎(chǔ)的多邊貿(mào)易體系,善意履行國(guó)際義務(wù),反對(duì)雙重標(biāo)準(zhǔn)和合則用、不合則棄。大家也都認(rèn)為應(yīng)堅(jiān)守國(guó)際法維護(hù)公平正義、促進(jìn)和平發(fā)展合作的核心價(jià)值,反對(duì)歪曲和濫用國(guó)際法,反對(duì)借國(guó)際法之名行霸權(quán)強(qiáng)權(quán)之實(shí)。
Second, developing countries, as important global forces, have made historic contributions to international development. They now have greater strength and responsibilities to uphold justice and rules. At this colloquium, all sides agree to stick to multilateralism in international rule-making and increase the representation and say of developing countries. We agree to encourage all countries to earnestly abide by international law, uphold the basic principles of the UN Charter, safeguard the rules-based multilateral trading system with the WTO at its core, fulfill our international obligations with good will, and reject double standards and selective application of rules. We all need to act on the core values of international law to uphold fairness, justice, peaceful development and cooperation and oppose distortion and abuse of international law. We reject hegemony and power politics in the name of international law.
中國(guó)始終是國(guó)際法的堅(jiān)定維護(hù)者和建設(shè)者。習(xí)近平主席提出的構(gòu)建人類命運(yùn)共同體這一重要思想已經(jīng)被載入中國(guó)憲法,這代表著中國(guó)堅(jiān)定走和平發(fā)展道路、堅(jiān)定維護(hù)國(guó)際法的莊嚴(yán)承諾。中國(guó)將繼續(xù)與發(fā)展中國(guó)家一道,共同維護(hù)以聯(lián)合國(guó)為核心、以國(guó)際法為基礎(chǔ)的國(guó)際秩序,推動(dòng)世界走上相互尊重、公平正義、合作共贏的正確道路。

This is China’s solemn commitment to peaceful development and international law. China will continue to work with other developing countries to uphold the UN-centered international order based on international law. We will jointly steer the world in the right direction of mutual respect, fairness, justice and win-win cooperation.

Q: Japanese Foreign Minister Taro Kono said on July 29 that countries that are not signed parties to the Intermediate-Range Nuclear Forces Treaty (INF Treaty) are enlarging their arsenals. If this treaty is no longer effective, there must be a new framework covering the US, Russia, China, the UK and France. On the same day, US Secretary of State Pompeo said that he hopes China can be part of the strategic dialogue between the US and Russia, and that China should be part of the relevant agreement. I wonder if you have any response to that?
答:中方已多次表明在《中導(dǎo)條約》問(wèn)題上的立場(chǎng)。
A: China has made clear its position on the INF Treaty on many occasions.
中方對(duì)美國(guó)單方面退約導(dǎo)致《中導(dǎo)條約》可能被廢棄表示關(guān)切和反對(duì)。希望美俄兩國(guó)通過(guò)對(duì)話解決分歧,努力保留該條約。這對(duì)維護(hù)全球戰(zhàn)略穩(wěn)定、維護(hù)地區(qū)和平與安全、維護(hù)大國(guó)之間的互信都有好處。
China is concerned about and opposed to the possible annulment of this treaty due to the US unilateral withdrawal from the treaty. We hope the US and Russia can resolve differences through dialogue and make efforts to preserve the treaty. It will be good for global strategic stability, regional peace and security and mutual trust between major countries.
關(guān)于《中導(dǎo)條約》多邊化問(wèn)題,我們之前也說(shuō)過(guò),該條約是美俄達(dá)成的雙邊性質(zhì)的條約,其多邊化涉及一系列政治、軍事、法律等復(fù)雜問(wèn)題,不少國(guó)家對(duì)此都是存有關(guān)切的,中方也不會(huì)同意。河野外相所謂“新框架”其實(shí)是沒(méi)什么新意的,無(wú)助于挽救《中導(dǎo)條約》,反而是變相為美國(guó)的單方面退約尋找或者提供了借口。
Regarding the expansion of the INF Treaty, as a bilateral treaty between the US and Russia, its expansion will lead to a series of complex issues covering political, military, legal and other areas. Many countries have concerns about it. China will not agree to it either. The so-called “new framework” proposed by Mr. Kono in its essence is not new at all. It won’t help to preserve the INF Treaty. Instead, it only finds or rather gives the US new excuses for its unilateral withdrawal from the treaty.
需要強(qiáng)調(diào)的是,中國(guó)始終奉行防御性國(guó)防政策,發(fā)展中導(dǎo)等能力完全出于防御目的,無(wú)意也不會(huì)對(duì)任何國(guó)家構(gòu)成威脅。美方退約的真實(shí)目的是給自己松綁,卻拿中國(guó)說(shuō)事,毫無(wú)道理,中方也不會(huì)接受。如果日方真正關(guān)心地區(qū)安全問(wèn)題,就應(yīng)該努力勸說(shuō)美國(guó)不要單方面退約。
I’d like to stress that China pursues a defense policy that is defensive in nature. Our purpose to develop intermediate-range missiles is entirely self-defense. We do not intend to and will not pose a threat to any country. The real intention of the US withdrawal is to make the treaty no longer binding on itself. Bringing China into this is just an unreasonable move. China will not accept it. If Japan truly cares for regional security, it should persuade the US not to exit the treaty in the first place.
關(guān)于蓬佩奧先生所說(shuō)的讓中國(guó)加入美俄對(duì)話和協(xié)議,我們認(rèn)為這是一種變相“甩鍋”。中國(guó)主張全面禁止和徹底銷毀核武器,但核裁軍應(yīng)遵循“各國(guó)安全不受減損”這一國(guó)際公認(rèn)的軍控基本原則。美國(guó)是世界上最大的核武器國(guó)家,在核裁軍方面負(fù)有特殊優(yōu)先責(zé)任。美國(guó)應(yīng)在切實(shí)履行現(xiàn)有條約基礎(chǔ)上,進(jìn)一步大幅削減核武器,為其他國(guó)家參加核裁軍談判創(chuàng)造條件,而不是向別國(guó)推卸責(zé)任。
Mr. Pompeo is also shifting the blames by saying China can be part of the relevant dialogue and agreement between the US and Russia. China stands for the comprehensive prohibition and complete elimination of nuclear weapons. However, nuclear disarmament should follow a basic principle, which is international recognized, that the security of all countries shall not be undermined. The US, as the largest nuclear state, has special and primary responsibilities in nuclear disarmament. The US should earnestly act on the current agreements and continue to drastically reduce nuclear arms. It should create favorable conditions for other countries to participate in nuclear disarmament negotiations instead of shifting blames to others.
