8月26日，第十三屆全國人大常委會(huì)第十二次會(huì)議表決通過了關(guān)于修改土地管理法的決定，明確土地所有權(quán)，改進(jìn)土地管理，規(guī)范政府土地征收行為。修改后的《中華人民共和國土地管理法》規(guī)定，土地(包括農(nóng)民集體所有的土地)的所有權(quán)和使用權(quán)的登記，依照有關(guān)不動(dòng)產(chǎn)登記的法律、行政法規(guī)執(zhí)行。

China's top legislature on Monday adopted a revision to the land administration law to clarify land ownership rights, improve administration and regulate government land requisition. The registration of ownership and use right of the land, including the land owned by a rural community, should follow the same law and administrative regulations applied on the registration of real estate, according to the revised law, adopted by the Standing Committee of the National People's Congress at its bimonthly session.

【知識(shí)點(diǎn)】

修改后的《中華人民共和國土地管理法》規(guī)定，依法登記的土地的所有權(quán)和使用權(quán)受法律保護(hù)，任何單位和個(gè)人不得侵犯。

農(nóng)民集體所有和國家所有依法由農(nóng)民集體使用的耕地、林地、草地，以及其他依法用于農(nóng)業(yè)的土地，采取農(nóng)村集體經(jīng)濟(jì)組織內(nèi)部的家庭承包方式承包，不宜采取家庭承包方式的荒山、荒溝、荒丘、荒灘等，可以采取招標(biāo)、拍賣、公開協(xié)商等方式承包，從事種植業(yè)、林業(yè)、畜牧業(yè)、漁業(yè)生產(chǎn)。家庭承包的耕地的承包期為三十年，草地的承包期為三十年至五十年，林地的承包期為三十年至七十年;耕地承包期屆滿后再延長(zhǎng)三十年，草地、林地承包期屆滿后依法相應(yīng)延長(zhǎng)。

【重要講話】

鞏固和完善農(nóng)村基本經(jīng)營制度，深化農(nóng)村土地制度改革，完善承包地“三權(quán)”分置制度。保持土地承包關(guān)系穩(wěn)定并長(zhǎng)久不變，第二輪土地承包到期后再延長(zhǎng)三十年。深化農(nóng)村集體產(chǎn)權(quán)制度改革，保障農(nóng)民財(cái)產(chǎn)權(quán)益，壯大集體經(jīng)濟(jì)。

We will consolidate and improve the basic rural operation system, advance reform of the rural land system, and improve the system for separating the ownership rights, contract rights, and management rights for contracted rural land. Rural land contracting practices will remain stable and unchanged on a long-term basis; the current round of contracts will be extended for another 30 years upon expiration. We will press ahead with reform of the rural collective property rights system, safeguard the property rights and interests of rural people, and strengthen the collective economy.
