侮辱國歌或入刑 情節(jié)嚴重者最高可判3年

10月31日，《刑法修正案(十)(草案)》提交十二屆全國人大常委會第三十次會議審議，草案擬在刑法第299條侮辱國旗、國徽罪中增加一款規(guī)定，明確侮辱國歌情節(jié)嚴重的，處三年以下有期徒刑、拘役、管制或者剝奪政治權(quán)利。

全國人大常委會審議《刑法修正案(草案)》，擬將侮辱國歌行為列入刑法處罰。

今年10月1日，《國歌法》(National Anthem Law)正式實施。其中規(guī)定應當奏唱國歌的場合包括：黨和國家機關(guān)的重大會議(major sessions of the Party and the nation)、重大儀典(major celebrations)、重大外交活動(important diplomatic occasions)及重大體育賽事(major sport events)，還有舉行升國旗儀式的時候(flag raising ceremonies)。同時，明確了不得奏唱國歌的場合，即不得用于商標和商業(yè)廣告，不得在私人喪事活動等不適宜場合使用("inappropriate" private occasions)，不得作為公共場所的背景音樂(background music in public places)等。同時，《國歌法》也規(guī)定了侮辱國歌行為的處罰方式。

全國人大常委會法制工作委員會副主任王超英介紹，國歌(national anthem)和國旗(national flag)、國徽(national emblem)一樣，都是國家的象征和標志。為了依法維護國旗、國徽的尊嚴，懲治侮辱國旗、國徽的犯罪行為，刑法第299條規(guī)定了侮辱國旗、國徽罪，明確了刑事責任(criminal responsibility)?！秶璺ā吠ㄟ^后，有必要對刑法第299條作相應補充，明確侮辱國歌行為的刑事責任。

為此，刑法修正案(十)草案在第299條中增加一款規(guī)定為，在公共場合，故意篡改中華人民共和國國歌歌詞、曲譜(maliciously modify the lyrics and music)，以歪曲、貶損方式奏唱國歌(play or sing the national anthem in a distorted or disrespectful way)，或者以其他方式侮辱國歌，情節(jié)嚴重的，處三年以下有期徒刑(up to three years of imprisonment)、拘役(criminal detention)、管制(criminal control)或者剝奪政治權(quán)利(deprivation of political rights)。

《刑法》第二百九十九條 【侮辱國旗、國徽罪】

在公眾場合故意以焚燒、毀損、涂劃、玷污、踐踏等方式侮辱中華人民共和國國旗、國徽的，處三年以下有期徒刑、拘役、管制或者剝奪政治權(quán)利。

Whoever purposely insults the national flag, national emblem of the PRC in a public place with such methods as burning, destroying, scribbling, soiling, and trampling is to be sentenced to not more than three years of fixed-term imprisonment, criminal detention, control or deprived of political rights.
