領(lǐng)導(dǎo)干部“干預(yù)司法”將被記錄

The Communist Party of China Central Committee and State Council published a host of measures on Monday to record all officials who interfere in judicial cases and to publicly name violators to hold them accountable in the latest effort to ensure judicial independence and transparency.

中共中央和國務(wù)院30日公布了一系列措施，將對所有干預(yù)司法案件的官員記錄在案，公布其姓名并追究責(zé)任，這是中央為了確保司法獨(dú)立和透明出臺的最新政策。

“干預(yù)司法”可以用meddle/interfere in judicial activities表示，這兩個詞在這里均指“干預(yù)、插手”，不過，當(dāng)interfere與with連用時，多表示“妨礙、沖突”，比如，Drug problems frequently interfered with his work.(吸毒問題頻繁干擾到他的工作。)

規(guī)定指出，官員干預(yù)司法的行為包括：為案件當(dāng)事人說情(interceding for litigants)、要求辦案人員或辦案單位負(fù)責(zé)人私下會見案件當(dāng)事人或其辯護(hù)人(asking personnel handling cases to meet with litigants or their defenders privately)、以聽取匯報、開協(xié)調(diào)會、發(fā)文件等形式，超越職權(quán)對案件處理提出傾向性意見或者具體要求的(overstepping their authority to make suggestions or directions on handling cases by means of hearing reports, holding coordination meetings or issuing circulars)等。

領(lǐng)導(dǎo)干部打擊報復(fù)司法人員(retaliate against judicial personnel)，或干預(yù)司法造成嚴(yán)重后果的，依照有關(guān)規(guī)定給予紀(jì)律處分(disciplinary penalties)，構(gòu)成犯罪的，依法追究刑事責(zé)任。
