賣方按時(shí)提交貨物,是買賣合同中規(guī)定的賣方基本義務(wù)。尤其是季節(jié)性商品,節(jié)日商品,交貨更要準(zhǔn)時(shí)。否則對(duì)方有權(quán)取消合同,而且還可以要求賠償。遇到因貨物未能及時(shí)運(yùn)到的抱怨時(shí),應(yīng)該首先安撫對(duì)方不要著急,并表明將盡快查出原因。然后要迅速查明詳情同時(shí)做出相應(yīng)對(duì)策,盡快給對(duì)方答復(fù)。

on one's plate不可耽誤

on one's plate的字面意思是在某人的盤子里,然而它實(shí)際上的意思與盤子沒有關(guān)系!而是把要做的事或要完成的任務(wù)比喻為盤子里的飯菜,太多了怎么也吃不完,但這些工作還一定要做,不可耽誤。例如:I can't help you at the moment. I've already far too much on my plate.我現(xiàn)在無法幫助你,我自己的事已經(jīng)太多了。

場(chǎng)景應(yīng)用

由于不可抗力導(dǎo)致貨物無法按時(shí)送達(dá),賣方通過傳真通知了買方,但買方表示沒有收到傳真。

A:Let's cut to the chase. According to our contract, the machines should be available for us to collect from the shipping agent on August 20th, 20011, but it was not until October 20th. You delayed the delivery for about two months. And this has seriously hindered our project development. All these have caused us a great loss.

B:We are sorry about the delayed delivery. We failed to deliver the machines in time because of force majeure circumstances—our vessel had run a ground and we had to put it under repairs. Here's the certificate.

A:And you should have notified us about it in time, but you did not. You failed to notify us about the delay. It's your obligation to make us the compensation.

B:We did immediately notify you through fax. You should have checked your secretary.

A:Our fax machine opens 24 hours, but we didn't receive it. And I also checked with my secretary. I think it's your fault.

B:We sent you the fax certainly. If you insist on saying no, we have no way out.

cut to the chase這個(gè)習(xí)慣用語(yǔ)來自好萊塢電影。很多人都知道chase這個(gè)詞是“追趕”的意思,在口語(yǔ)里,就用cut to the chase來表示“言歸正傳,只談重點(diǎn)”的意思。現(xiàn)在cut to the chase也被廣泛應(yīng)用在商界,表示,“開門見山,直奔主題,言歸正傳”,意味著直接處理最要緊的問題,別廢話。例如:OK. Let's cut to the chase: tell me what you want and I'll do my best to help you.(好吧,直說吧,告訴我你想要什么,我會(huì)盡力幫你的。)

A:Yes. You know, sweaters are seasoning goods. We signed a contract of 70,000 sweaters in March. The goods should have arrived in Dalian no later than late September, but it arrived on October 30th when it was too late for us to have them distributed.

B:We did have the sweaters delivered according to the contract stipulations, you might have noticed it from the shipping advice we sent you.

A:I've studied all the necessary documentations, including the shipping advice. That advice told us the vessel would be sailing for Dalian via Paris and Bangkok on August 30th. Unfortunately when the vessel called at Bangkok, the dockers were on strike, which caused almost twenty days delay of its arrival in Dalian.

B:You'd had the cargo insured against S.R.C.C., hadn't you? In that case, your claim should be referred to the insurance company for compensation.

A:I like that, and what I'd like to remind you of is that it was stipulated in the contract that the goods would be delivered in early August. If the goods had been delivered before August 20th, the strike in Bangkok would not have affected the punctual arrival of the goods. Therefore you are responsible for our loss.
