根據(jù)國民經(jīng)濟(jì)和社會發(fā)展第十四個五年規(guī)劃，國家知識產(chǎn)權(quán)局將加強(qiáng)知識產(chǎn)權(quán)保護(hù)工作頂層設(shè)計(jì)。國家知識產(chǎn)權(quán)局已基本完成了知識產(chǎn)權(quán)強(qiáng)國戰(zhàn)略綱要和“十四五”知識產(chǎn)權(quán)保護(hù)和運(yùn)用規(guī)劃的起草工作，并將推動商標(biāo)法的新一輪修改研究。
The National Intellectual Property Administration (NIPA) will improve the top design of intellectual property rights (IPR) protection according to the outline of the country's 14th five-year plan for national economic and social development. The NIPA has basically completed the drafting of the plan for further implementation of the national intellectual property strategy to accelerate the construction of an intellectual property power country and the IPR protection and application plan for the 14th Five-Year Plan period and is promoting a new round of research on revising the Trademark Law.

今年4月26日是第21個“世界知識產(chǎn)權(quán)日”，今年也是“十四五”規(guī)劃的開局之年，對于未來五年的知識產(chǎn)權(quán)工作，“十四五”規(guī)劃綱要作了新的明確部署。國民經(jīng)濟(jì)和社會發(fā)展第十四個五年規(guī)劃提出，實(shí)施知識產(chǎn)權(quán)強(qiáng)國戰(zhàn)略，實(shí)行嚴(yán)格的知識產(chǎn)權(quán)保護(hù)制度，完善知識產(chǎn)權(quán)相關(guān)法律法規(guī)，加快新領(lǐng)域新業(yè)態(tài)知識產(chǎn)權(quán)立法。加強(qiáng)知識產(chǎn)權(quán)司法保護(hù)和行政執(zhí)法，健全仲裁、調(diào)解、公證和維權(quán)援助體系，健全知識產(chǎn)權(quán)侵權(quán)懲罰性賠償制度，加大損害賠償力度。優(yōu)化專利資助獎勵政策和考核評價機(jī)制，更好保護(hù)和激勵高價值專利，培育專利密集型產(chǎn)業(yè)。改革國有知識產(chǎn)權(quán)歸屬和權(quán)益分配機(jī)制，擴(kuò)大科研機(jī)構(gòu)和高等院校知識產(chǎn)權(quán)處置自主權(quán)。完善無形資產(chǎn)評估制度，形成激勵與監(jiān)管相協(xié)調(diào)的管理機(jī)制。構(gòu)建知識產(chǎn)權(quán)保護(hù)運(yùn)用公共服務(wù)平臺。
下一步，國家知識產(chǎn)權(quán)局將做好配套的頂層設(shè)計(jì)，同時將完善制度機(jī)制，重點(diǎn)落實(shí)好懲罰性賠償制度，加快人工智能、大數(shù)據(jù)等新領(lǐng)域新業(yè)態(tài)知識產(chǎn)權(quán)立法。此外，將持續(xù)深化改革，重點(diǎn)優(yōu)化專利資助獎勵政策和考核評價機(jī)制，突出高質(zhì)量發(fā)展主題，更好地保護(hù)和激勵高價值專利，壯大專利密集型產(chǎn)業(yè)。另外，還要加強(qiáng)基礎(chǔ)建設(shè)，包括加強(qiáng)知識產(chǎn)權(quán)信息化、智能化基礎(chǔ)設(shè)施建設(shè)，加快建設(shè)國家知識產(chǎn)權(quán)大數(shù)據(jù)中心，構(gòu)建知識產(chǎn)權(quán)保護(hù)運(yùn)用公共服務(wù)平臺。

要加強(qiáng)知識產(chǎn)權(quán)保護(hù)工作頂層設(shè)計(jì)。要研究制定“十四五”時期國家知識產(chǎn)權(quán)保護(hù)和運(yùn)用規(guī)劃，明確目標(biāo)、任務(wù)、舉措和實(shí)施藍(lán)圖。既嚴(yán)格保護(hù)知識產(chǎn)權(quán)，又確保公共利益和激勵創(chuàng)新兼得。
The top-level design for intellectual property rights (IPR) protection should improve. China will create a national plan for IPR protection and application for the 14th Five-Year Plan period from 2021 to 2025, specifying goals, tasks, measures and a blueprint for implementation. The plan should strictly protect IPR, ensure public interests, and create incentives for innovation.
