華為宣布起訴美國政府

Huawei said it had filed a complaint in a federal court in Texas challenging the constitutionality of Section 889 of the National Defense Authorization Act (NDAA), a section signed into law by the US president in August that banned federal agencies and their contractors from procuring its equipment and services.

華為表示，美國政府針對華為的美國國防授權(quán)法889條款違憲，華為已經(jīng)在德州東區(qū)聯(lián)邦法院正式起訴。該條款由美國總統(tǒng)8月簽署入法，禁止美國行政部門機構(gòu)獲取華為的通訊硬件產(chǎn)品和服務(wù)。

華為輪值董事長郭平宣布，華為已向美國聯(lián)邦法院提起訴訟，指控美國2019年國防授權(quán)法第889條款違反美國憲法。

郭平表示：

The US Congress has repeatedly failed to produce any evidence to support its restrictions on Huawei products. We are compelled to take this legal action as a proper and last resort.

美國國會通過立法懲罰華為，且從未展示支持這些限制條款的證據(jù)，因此，華為不得不決定通過法律行動予以回應(yīng)。

This ban not only is unlawful, but also restricts Huawei from engaging in fair competition, ultimately harming US consumers. We look forward to the court's verdict, and trust that it will benefit both Huawei and the American people.

該限制條款違背了美國憲法，妨礙華為參與公平競爭，最終傷害的是美國消費者。我們希望法院能做出有益于美國消費者的正確決定。

此外，在此次發(fā)布會上，華為還透露，有證據(jù)表明美國政府涉嫌入侵華為服務(wù)器。

郭平稱，美國政府曾經(jīng)入侵華為服務(wù)器、竊取了大量的郵件和源代碼(The US government "has hacked our servers and stolen our e-mails and source code")，卻沒有找到任何華為會危害美國網(wǎng)絡(luò)安全的證據(jù)，可美國政府，以及像參議員馬克·盧比奧這樣的人，仍然堅持要污蔑華為公司。

Huawei noted the NDAA restrictions prevent the company from providing more advanced 5G technologies to US consumers, which will delay the commercial application of 5G.

華為指出，美國國防授權(quán)法阻止該公司為美國消費者提供更先進的5G技術(shù)，從而會延后5G商用的進程。

Guo Ping added, "If this law is set aside, as it should be, Huawei can bring more advanced technologies to the US and help it build the best 5G networks. Huawei is willing to address the US Government's security concerns. Lifting the NDAA ban will give the US Government the flexibility it needs to work with Huawei and solve real security issues."

郭平說：“如果撤銷這條法律(本來就應(yīng)當(dāng)撤銷這條法律)，華為就有機會向美國提供更加先進的技術(shù)，幫助美國建立最先進的5G網(wǎng)絡(luò)。華為愿意解決美國政府的安全擔(dān)憂。取消NDAA對華為的禁令可以讓美國政府與華為一起解決真正的網(wǎng)絡(luò)安全問題。”
