China adopted its first-ever law on overseas NGOs on Thursday to facilitate their legal operations on the mainland but to combat any activity that might harm national security.
中國28日通過了史上首部境外非政府組織管理法,以便于這些組織在大陸合法運行,同時打擊任何可能危及國家安全的行為。
The 54-point law clarifies the registration process, operational rules and liabilities of overseas NGOs, as well as measures for their operations in China.
該法共有54條,規(guī)定了境外非政府組織在中國運營的登記和備案、活動規(guī)范、法律責(zé)任以及監(jiān)督管理。
該法所稱境外非政府組織(overseas non-governmental organizations),是指在境外合法成立的基金會(foundations)、社會團體(social organizations)、智庫機構(gòu)(think tank)等非營利、非政府的社會組織(non-profit and non-governmental social organizations)。
境外NGO依照本法可以在經(jīng)濟、教育、科技、文化、衛(wèi)生、體育、環(huán)保等領(lǐng)域和濟困、救災(zāi)等方面開展有利于公益事業(yè)發(fā)展的活動。境外NGO在中國境內(nèi)不得從事或者資助營利性活動(profit-seeking activities)、政治活動(political activities),不得非法從事或者資助宗教活動(religious activities)。
法律規(guī)定,國家保障和支持境外NGO在中國境內(nèi)依法開展活動。各級人民政府有關(guān)部門應(yīng)當為境外NGO在中國境內(nèi)依法開展活動提供必要的便利和服務(wù)。國務(wù)院公安部門和省級人民政府公安機關(guān)會同有關(guān)部門制定境外NGO活動領(lǐng)域和項目目錄,公布業(yè)務(wù)主管單位名錄,為境外NGO開展活動提供指引。
