I have worked for a school for 12 years. I’ve always received excellent reviews and I am well-liked by my peers. However, we recently got a new boss who has a chip on his shoulder all the time. When I made a complaint to human resources about him and his secretary insulting my gender and age, he retaliated by not giving me any overtime. I complained to my union, superintendent of schools and another supervisor. All of them referred me back to human resources. I was told to wait and see. It is now six months later, and things are still the same. My recent review by my boss was not good, and he tells me if I’m not happy, I should quit. Since the union, human resources and the superintendent of schools allow him to keep insulting me, what would be my next recourse?

No one should be treated disrespectfully, under any circumstances, for any reason. But, that is a separate matter from getting a poor performance review. It’s not uncommon for a new boss to establish a different standard of performance and for employees who have previously earned good reviews to receive bad ones. But criticism about performance is not the same as being insulted and treated disrespectfully — although I have come across employees who can’t seem to make that distinction, and bosses who think “You really stink at your job and you should quit” is actually good feedback! The first thing to do is construct a timeline and document everything that has transpired thus far — dates, times, what was said and done, whom you spoke to. Ask for copies of all your performance reviews. If you are going to bring a claim against your employer, this is the information that will be required, and having it prepared in advance will help your credibility. Then, visit the Equal Employment Opportunity Commission and file a complaint. Or, you could go to an employment attorney and explain the situation. I think your case sounds like something they would be interested in looking into.
