中國就《數(shù)據(jù)安全管理辦法(征求意見稿)》征求公眾意見
China's Internet regulator started to solicit public opinions on data security regulation on Tuesday.
周二(5月28日),國家網信辦開始就《數(shù)據(jù)安全管理辦法(征求意見稿)》,向社會公開征求意見。
According to a draft regulation released by the Cyberspace Administration of China, network operators must not force or mislead users to agree to the collection of their personal information on the pretext of improving service quality, enhancing user experience, sending customized push messages or developing new products.
根據(jù)征求意見稿,網絡運營商不得以提高服務質量、增強用戶體驗、發(fā)送定制推送信息或開發(fā)新產品為由,強迫或誤導用戶同意收集其個人信息。
The regulation applies to network-based collection, storage, transmission, processing and use of data, as well as data security protection and supervision in China, said the draft.
意見稿明確,這項規(guī)定適用于在中國境內利用網絡開展的數(shù)據(jù)收集、存儲、傳輸、處理、使用等數(shù)據(jù)活動,以及數(shù)據(jù)安全的保護和監(jiān)督管理。
The draft requires network operators to make and release the rules of data collection and usage via websites or applications. The operators must not provide discriminatory services to users based on whether they accept personal information collection and the collection scope.
意見稿要求網絡運營者通過網站、應用程序等產品收集使用個人信息,應當分別制定并公開收集使用規(guī)則。經營者不得根據(jù)是否接受個人信息收集和收集范圍,向用戶提供歧視性服務。
The draft also requires operators to take remedial measures immediately when personal information leakage, damage, or loss happens, or when data security risks increase significantly.
意見稿還要求運營商在個人信息泄露、損壞或丟失或數(shù)據(jù)安全風險顯著增加時,應當立即采取補救措施。
The draft will be open for suggestions until June 28.
意見反饋截止時間為2019年6月28日。
