美團(tuán)、餓了么回應(yīng)偷聽質(zhì)疑

China's food delivery apps Meituan and Ele.me denied eavesdropping on customers through mobile phone microphones to provide targeted ads, said Beijing Daily on Tuesday.

19日,《新京報》稱,外賣app美團(tuán)和餓了么否認(rèn)通過手機(jī)麥克風(fēng)竊聽用戶通話來提供精準(zhǔn)推薦。

你遇到過這樣的情況嗎?剛說想吃什么、買什么,手機(jī)就出現(xiàn)相關(guān)商品的信息推薦。

驚不驚喜,意不意外!不少人懷疑:手機(jī)是不是偷聽了我的話?

3月18日,《IT時報》對這一現(xiàn)象的報道將兩家外賣平臺推上風(fēng)口浪尖。

On Monday, IT Times, a news provider focused on the digital industry, published a report suspecting that Meituan and Ele.me apps could be stealthily listening to users' private communications without their consent.

3月18日,數(shù)碼電子類產(chǎn)業(yè)雜志《IT時報》發(fā)布了一項(xiàng)報告,報告懷疑美團(tuán)和餓了么app在未經(jīng)用戶同意的前提下,偷聽人們的私人談話。

此消息一出,引起網(wǎng)友熱議。

為此,《IT時報》的記者耗時三個月模擬用戶的使用場景,對iPhone、Android手機(jī)和iPad上的美團(tuán)外賣和餓了么app進(jìn)行跟蹤測試。

The report said when the author talked to others that she wanted to eat Japanese cuisine, the Ele.me app recommended a Japanese restaurant to her just two minutes later.

報告稱,當(dāng)記者和他人提及她想吃日料時,餓了么就會在兩分鐘后向她推薦日料店。

She then tested some other keywords, including "Hong Kong food" and "tea shop". Sure enough, a few minutes later, the author found the mentioned food was placed in the top of the app's restaurant suggestions, even though she had never ordered it before.

之后,她又測試了“港式茶點(diǎn)”、“茶館”等關(guān)鍵詞。果不其然,幾分鐘后,相關(guān)餐廳位列平臺推薦榜首,而她之前從未點(diǎn)過這些食物。

從測試結(jié)果來看,在談及某種食物后,打開外賣app出現(xiàn)相關(guān)推薦的概率高達(dá)60%-70%。

According to the author's 3-month research, more than 70 percent of food or restaurants that she talked about appeared in the recommended places on the two delivery apps.

記者歷時三個月的調(diào)查發(fā)現(xiàn),她曾提及的食物或餐廳超過70%都出現(xiàn)在兩款外賣軟件的推薦里。

細(xì)思極恐!不少網(wǎng)友表示,自己也有類似的經(jīng)歷。

對此,美團(tuán)和餓了么均給出相關(guān)回應(yīng),否認(rèn)存在偷聽用戶對話。

Meituan said that they never collected users' voice data to recommend services. Only when users are actively searching for food or restaurants, will they make relevant recommendations.

美團(tuán)稱他們從未收集用戶語音數(shù)據(jù)來推薦服務(wù)。只有用戶頻繁搜索某些食物或餐館時,美團(tuán)才會做出相關(guān)推薦。

餓了么也回應(yīng)道,所謂“監(jiān)聽用戶日常對話并做信息分析”是一種無端猜測。

"Ele.me hasn't made such product settings, and from a technical perspective, the company is unable to do so," it said.

餓了么說:“餓了么沒有此類產(chǎn)品設(shè)置,也不具備相關(guān)的技術(shù)條件。”

然而,專家意見卻與之相左,稱技術(shù)上可實(shí)現(xiàn):

However, some tech experts disagree. Liu Quan, a senior researcher in China Center for Information Industry Development, told China Daily that there is no technical barrier for tech companies to make recommendations based on the voice information without users' permission.

然而,一些技術(shù)專家卻不同意這一點(diǎn)。中國電子信息產(chǎn)業(yè)發(fā)展研究院高級研究員劉權(quán)告訴《中國日報》,科技公司未經(jīng)用戶允許根據(jù)聲音信息做出推薦不存在技術(shù)障礙。

據(jù)稱,若互聯(lián)網(wǎng)公司未經(jīng)用戶允許擅自獲取用戶信息,將承擔(dān)法律責(zé)任。

Zhao Lei, a partner lawyer at Beijing Zewen Law Firm, said that if internet companies obtain users' information without the latter's consent, that might violate the law, and could even bring criminal charges to the company involved. However, that would require very exact evidence, which could be hard to collect.

北京市澤文律師事務(wù)所合伙人律師趙磊稱,如果互聯(lián)網(wǎng)公司未經(jīng)用戶允許擅自獲取用戶信息,可能會違反法律,甚至?xí)ι媸鹿咎崞鹦淌略V訟。然而,這需要確實(shí)的證據(jù),而這些證據(jù)很難搜集。
