全國首家互聯(lián)網(wǎng)法院在杭州成立

8月18日，杭州互聯(lián)網(wǎng)法院正式成立。作為全國首家互聯(lián)網(wǎng)法院，杭州互聯(lián)網(wǎng)法院探索用互聯(lián)網(wǎng)方式審理互聯(lián)網(wǎng)案件。當(dāng)事人足不出戶，點擊“杭州互聯(lián)網(wǎng)法院訴訟平臺”(www.netcourt.gov.cn)，杭州互聯(lián)網(wǎng)法院就能提供“網(wǎng)購”般便利的訴訟服務(wù)，起訴、立案、送達、舉證、開庭、裁判，每個環(huán)節(jié)全流程在線。

8月18日，杭州互聯(lián)網(wǎng)法院的法官參加憲法宣誓儀式。

China has set up its first court specializing in handling of internet-related disputes in Hangzhou, Zhejiang province, where many technology enterprises are located, amid rapid growth of online purchases and financial activities in the country.

隨著國內(nèi)網(wǎng)購和金融活動的飛速發(fā)展，中國在杭州成立了首家專門審理互聯(lián)網(wǎng)案件的法院。杭州是眾多高新技術(shù)企業(yè)的聚集地。

杭州互聯(lián)網(wǎng)法院(The Hangzhou Court of the Internet)負責(zé)審理六類涉互聯(lián)網(wǎng)民事、行政案件(civil and administrative internet-related cases)，包括互聯(lián)網(wǎng)購物、服務(wù)、小額金融借款等合同糾紛和互聯(lián)網(wǎng)著作權(quán)(online intellectual property rights)權(quán)屬、侵權(quán)糾紛等。

與普通法院相比，互聯(lián)網(wǎng)法院的法庭沒有原告、被告席(the plaintiff’s and the defendant's seats)，也沒有書記員(court clerk)，而是采用語音識別系統(tǒng)(speech recognition system)進行記錄。從立案(case filing)到庭審(court hearing)，訴訟的全部環(huán)節(jié)均可以在線完成(handle a lawsuit entirely online)，訴訟當(dāng)事人無需親自出庭(litigants do not have to go to the court in person)，在家就能打官司。

那么在互聯(lián)網(wǎng)法院打官司具體如何操作呢?

首先點擊法院官網(wǎng)www.netcourt.gov.cn進入杭州互聯(lián)網(wǎng)法院訴訟平臺，如果要起訴，需要通過手機注冊并實名認證后填寫起訴狀，如果立案通過，就可以在線繳納訴訟費(legal cost)了。

如果法院立案，就會通過短信通知被告應(yīng)訴(Defendants will be notified via text messages if the court files the case)。

庭審將通過遠程視頻系統(tǒng)(remote video system)在線進行。原被告都需保持網(wǎng)絡(luò)暢通。

案件宣判后，如果不服法院判決(if litigants disagree with the verdict)，可以到杭州市中級人民法院(intermediate people's court)上訴。
